Feb 25th is crossover day when House bills go to the Senate and Senate bills go to the House. So sometime after that we go through review and voting again.

Another message via our friend Mike Frohlich

Quick update on HB 1339... It was scheduled for a vote on the house floor yesterday, but US Rep. Rick Berg gave a speech to the chamber, so there was no 11th order of business yesterday. Todays schedule lists it as the 8th bill under the 11th order. I'll keep you posted! Cheers!

It looks like they didn't get to this bill today and it is set for a vote tomorrow.

I kept on checking back on the House Calendar page to see what was going to happen and it stalled a few bills in and now it lists the calendar for the 28th so maybe they will vote tomorrow.

HB 1339 Allowing for the creation of a domestic brewery will be up for a vote on the house floor sometime after 1pm.

Well, allow me to tell you directly! Honestly, it's not really fair to use my entire experience as a benchmark in regard to working at a microbrewery for a couple reasons. The primary one, was that they weren't able to pay me for my actual labor, only for my time working in the serving rooms (minimum wage plus any tips). The other reason is that the brewmaster/owner was a bit of a Prima Donna. Obviously, those factors will vary depending on where you'd work or if you own your own microbrewery!

Anyway, it is hard, physical work. It's just like brewing at home, with bigger, heavier equipment that needs even more fastidious care and sanitation. However, it is a pretty cool experience to step into a mash tun with waders on and clean out a mash tun. The other thing I found out the hard way is that when you use a pressure hose to clean out a 10 bbl fermenter is that the CO2 will rise out of the remaining yeast cake really quickly and almost knock you unconscious. Embarassed

I enjoyed the camaraderie, the patrons and the feeling of doing something I enjoyed day to day. I didn't, however, enjoy the pay, or lack thereof and the management quite as much. I learned a great deal about the business and the process while I was there, which is indispensable. Even though these guys were still struggling to get on their feet when I had left for North Dakota, they are still there doing their thing, so it must've worked out.

Without going on and on, the main thing I learned is that working for a commercial microbrewery is fun for a (fairly long) while, but like all good things, it can wear on you eventually and get old. I also learned enough about it to determine that I wouldn't want to stake my family and livelihood on consumer's fickle tastes or have to "dumb down" my beer to suit the lowest common denominator. You can say what you want about the number of True Believers in the trench out there who spread the gospel of beer, but there's simply not enough of them to keep a mid-scale microbrewery running (if only because they're homebrewers first!). And that, unfortunately, is where the dumbing-down becomes a potential factor.

That's my $0.02, though your mileage may vary, as they say.

I don't really know much about this new bill. I'll be honest, my look at commercial brewing has been soured. I'm just happy that ND is looking to reformulate some of the old laws. I know the local wine industry has been pushing hard to have changes made. I'm confused as to what is going regarding distribution in this bill, but I think what its really going to change is to allow people to sell beers at tradeshows, farmers markets, and other local events. At least, that is what I would hope to see.

What I was referring to regarding distribution is that according to ND law, producers of alcohol cannot distribute for resale. The producer HAS to go through a distributor, and in my opinion the distributors here have quiet a hold on things. ND is one of two states that doesn't allow at least small amounts to be distributed by the producer. For example, the brewery my husband worked for in WI owned a small van that they used to deliver kegs. They were they're own distributor. To find a distributor here interested in a start up removes a good bit of profits from manufacturing. It would be nice if there was a limitation put on to how much a person could distribute on their own.

HA! Just got done reading through the discussion! Nice plug Randi!

I was just gonna +1 to what Randi said about the 10-4 recommendation to pass. I sent an email to Dan Ruby yesterday to say thanks for fighting for brewer rights in ND. He wrote back informing me about the 10-4 pass on recommendation.

I have a question though.....from what i understand, this would allow home brewers to sell their own brew, correct? What about federal (ATF) laws? Would this bill make it so I can slap a label on a couple bottles and as long as I have the $100 license I should be ok to sell them?

Also, Randi, you said in your comment on the Tribune page that ND laws makes it so micro brewers can not distribute which hinders microbreweries in the state. Would this bill basically change that? What about someone that would own a brew pub? Can you make and sell in your own restaurant, just not beyond that?

Sorry for all the questions, I just am unfamiliar with the laws surrounding beer production in ND.

Good to yeare it came through with a do pass recommendation.

I thought self distribution was originally not allowed so the comment "with the change that would not allow for self distribution" has be a bit confused unless the change was to actually allow it but Mike had a typo.

I did not get far before i saw the same old stuff, political bias, it amazes me at how little people care about, and the things they actually are willing to fight for are not worth fighting for. i mean folks want to argue over an R or D really, because he is an R or a D really effect the man he is? or has anything to do with the bill? i don't even know what the affiliates party is. but does that even matter?

sadlly our political system is so broke, i don't think it can be fixed.

i wish they would look at a good bill and pass it because it is good!

self distribution is a biggy, in my opinion, because the cost of distribution is were ND is failing in the start of brewries. that and the states does not allow a place to have a beer exclusive to them. like if i maked a buckarroo beer, and Buck's wanted be the only ones who could sell it, then you could have a customer and support your brewing interests. this state needs to catch up with the times!

It looks like that bill amends the domestic winery law to allow self-distribution, something not allowed in the proposed domestic brewery law.

MN allows self distribution and it helps Surly and other breweries grow so I would like to see it as an option for ND if possible.

I've heard that this was coming up, but I don't know much more than that. I know Dan was working on a rural distillery law of some sort last year.

That would really help boost craft beer in the state. Might give those guys that think they can throw anything at us and we'll take it out of desperation, a run for their money.

BISMARCK, N.D. (AP) - North Dakotans who make wine and booze already can get a state license to sell their beverages, and a Minot lawmaker wants people who make home-brewed beer to be able to do the same.
Republican Dan Ruby's bill is getting a hearing in the North Dakota House's Industry, Business and Labor Committee on Monday. It would establish a domestic brewery license in state law.
Ruby said the license would let home beer brewers sell their suds. They could offer beer tastings and set up stalls at trade shows. They could also sell their beer to wholesalers for wider state distribution.

Ruby said North Dakota is a leading barley producer, and it should be easier for home beer makers to market their goods.
